Private hire terms

These terms apply when you hire all or part of Swindlers, 19 Aberdeen Walk, Scarborough, for a private event. The venue is run by Swindlers Ltd (company number 17477672). They form the agreement between you (the person who makes the booking) and us, together with your written quote and confirmation.

Enquiries and quotes

  • An enquiry through our website doesn't reserve a date. Nothing is booked until we confirm it in writing and receive your deposit.
  • Our quote sets out the space, date, times, number of guests, package, food and drink, and the price. Quotes are valid for [TO CONFIRM: number] days.

Deposits and payment

  • To confirm your booking we need a deposit of [TO CONFIRM: amount or percentage]. Until we receive it, we may release the date to someone else.
  • The deposit [TO CONFIRM: is / is not] refundable and is taken off your final bill.
  • The balance is due [TO CONFIRM: for example, 14 days before the event]. Anything extra ordered on the night (such as a bar tab) is payable at the end of the event.
  • Minimum spend. [TO CONFIRM: whether a minimum spend applies to any spaces or days. If you don't reach it, the difference is charged as a room hire fee.]
  • Final numbers and any pre-orders are due [TO CONFIRM: number] days before the event. We'll charge for the confirmed numbers even if fewer guests attend.

Cancelling or changing your booking

We'll always try to re-let the space, and we'll reduce what you owe if we can.

If we have to cancel, for example because of events outside our control, we'll refund everything you've paid, or offer another date if you'd prefer.

To change the date, times or package, please ask us. Changes depend on availability and may change the price.

On the day

  • Times. Your event runs between the times confirmed in writing. Access for setting up is by arrangement. Our licensed hours are [TO CONFIRM: licensed hours / last orders].
  • Exclusive hire. If you hire the whole venue, it will be closed to the public for your event. If you hire part of it, the rest of the venue stays open as normal.
  • Age and ID. Our booking terms on age and Challenge 25 apply to all guests. You're responsible for making sure under-18s at your event are supervised.
  • Behaviour. You're responsible for your guests' behaviour. We may refuse service, ask guests to leave or end the event early if anyone is drunk, abusive or puts others at risk, or if our licence conditions would be breached. No refund is due in that case.
  • Damage. You're responsible for any damage to the venue, fixtures or equipment caused by you or your guests, beyond normal wear and tear. [TO CONFIRM: whether you take a damage deposit.]
  • Decorations and suppliers. Please agree decorations, entertainment and outside suppliers (such as DJs, cakes or photographers) with us in advance. No confetti, glitter, naked flames or anything fixed to walls, unless we agree. [TO CONFIRM] Outside suppliers need their own public liability insurance.
  • Food and drink. No food or drink may be brought in without our agreement, apart from a celebration cake. [TO CONFIRM: any cake-cutting fee.] Please give us guests' allergies and dietary needs with your final numbers. See our allergen statement.
  • Gaming. [TO CONFIRM: if card or casino evenings are offered, the conditions that keep them within the Gambling Act 2005, such as no real-money stakes on "fun casino" nights.]
  • Music and noise. We're in a town-centre location with neighbours. Music volumes and finish times must follow our licence conditions and staff instructions.

Our responsibility

  • We'll provide the space and services we've confirmed with reasonable care and skill.
  • We aren't liable for losses we couldn't reasonably have foreseen, or for guests' belongings, except where caused by our negligence.
  • Nothing in these terms limits our liability for death or personal injury caused by our negligence, or anything else that can't be limited by law.
